When are you entitled to a disability pension?

What to do to get a disability pension?
You have to apply for an disability pension at the branch of the Social Insurance Agency according to your place of residence. The form is very complicated, rather an employee of the insurance company will take it with you. From the time you submit your application, you have the right to inspect your file, make extracts, transcripts, and photocopies at any time. The form for obtaining a disability pension is available at all branches of the Social Insurance Agency, as well as on the website of the Social Insurance Agency.
What must not be missing in the application for a disability pension?
Along with the application, it is necessary to submit years of service (via pension insurance records) and medical documentation, ie. current professional medical findings. Indicate in the application the date from which you are claiming an disability pension.
What if my application for an disability pension is rejected?
Disability pensions are decided by the Headquarters of the Social Insurance Agency. It is obliged to decide on the application within 60 days of submission, in complex cases within 120 days. If you think that the disability pension decision is incorrect, for example by rejecting your application or disagreeing with a set rate of decline in the ability to work, you have the right to appeal against it within 30 days of receiving the decision. The appeal is filed with the Social Insurance Agency. When writing an appeal, it is advisable to adhere to the facts related to the medical condition proven by medical reports.
The amount of the disability pension
In the new pension system, the amount of the disability pension depends on the income of the citizen during the whole working life (before the onset of the disability). This means that a citizen who earned more and therefore paid higher contributions during his lifetime will have a higher disability pension with the same reduction in the ability to work than a citizen who earned less during his life and also paid lower contributions. The worst case is self-employed people who paid minimal or no contributions.
How is a disability pension paid?
The disability pension is paid in advance, always in regularly recurring, monthly payment periods. The payout date is determined by the Social Insurance Agency for each individual.
Work in addition to a disability pension
In the new pension system, a citizen can work without restriction while receiving an disability pension. Disability pension is not limited in any way. Recipients of disability pensions are not limited at work in any way, only by their health options. They can receive a full disability pension and work without restriction at the same time. The payment of an disability pension is not conditioned by the amount of income earned or by the type of gainful activity. A disabled pensioner is not restricted by the Labor Code either.
